1. Introduction

This Privacy Policy explains how Skulpt ("App", "we", "our", or "us") collects, uses, stores, and shares information when you use the Skulpt mobile application on iOS or Android or visit skulpt.app ("Website"). The App and Website are referred to together as the "Services".

Please read this policy before using the Services. If you do not agree with it, please do not use the Services.

We may update this policy as the Services change. We will show the date of the latest revision at the top of this page and provide any additional notice required by law.

2. Information We Collect

The information we collect depends on the features you use. Some information stays on your device, while other information is sent to our servers or service providers as described below.

2.1 Information You Provide to Us

You may provide or import the following information:

  • Workout and fitness data, including workout plans, exercises, sets, repetitions, weights, distances, durations, notes, and performance metrics;
  • Health and measurement data, including body measurements, body weight, heart rate, calories, and other workout-related health data that you enter or choose to import from Apple Health or Health Connect;
  • Optional profile information used for health and heart-rate features, such as your date of birth, biological sex, activity level, and maximum heart-rate settings;
  • Personal preferences and settings, such as measurement units, language, time zone, notification preferences, and display theme;
  • Other content you create in the App, such as custom exercise details and free-text notes.

2.2 Information Collected Automatically

When you access or use the App, we automatically collect certain information, including:

  • Device information, such as your device brand, model, type, operating system name and version;
  • Application information, such as the app version, build number, and application identifiers;
  • Usage information, such as the features you use, screens you view, actions you take within the App, and the dates and times of your activities;
  • A randomly generated Skulpt user identifier, push notification tokens, and notification settings;
  • Locale and regional information, such as language, region, time zone, currency, calendar type, and text direction;
  • App lifecycle and product usage information, such as app installation, opening, updating, screens viewed, features used, actions taken, event outcomes, and associated dates and times;
  • Network information, including your IP address. Our analytics provider may use it to derive an approximate country or region. We do not collect precise GPS location for analytics;
  • Crash reports, error logs, and diagnostic data used to maintain and improve the App's performance and stability.

2.3 App Product Analytics and Tracking

We use PostHog to understand how the App is used and to improve its features. Analytics events are associated with the randomly generated Skulpt user identifier and may include app and device details, lifecycle events, screen views, product actions, event outcomes, and approximate country or region derived from your IP address.

We do not send workout names, exercise names, free-text notes, search queries, body measurement values, or raw heart-rate samples to PostHog.

Skulpt does not access advertising identifiers, show third-party advertising, track you across apps or websites owned by other companies, or provide data to data brokers.

2.4 Website Analytics

We use PostHog on the Website to measure page visits and clicks on the App Store and Google Play links. Website events may include the page path, site language, destination store, link placement, browser and device details, and approximate country or region derived from your IP address.

The App Store link contains fixed Apple provider and campaign tokens so we can measure downloads attributed to the Website. The tokens identify the link, not a person, and contain no user-entered data.

If a link to the Website contains campaign parameters, we collect only utm_source, utm_medium, utm_campaign, utm_content, and utm_term. We also record the referring site's origin, such as https://example.com, without its path or query. Other URL query parameters and fragments from the Website address are removed before an event is sent.

Website analytics uses a random identifier stored only in the memory of the current browser tab. We do not store that identifier in cookies or local storage. It resets when the page is reloaded or the tab is closed. Automatic interaction capture, user profiles, and session replay are disabled on the Website.

3. How We Use Your Information

We use the information described above to:

  • Provide, operate, maintain, and improve the App and its features;
  • Personalize your experience within the App;
  • Store and synchronize your data across sessions and devices;
  • Provide optional Apple Health and Health Connect features, including importing measurements and exporting completed workouts;
  • Send you push notifications related to your workouts, reminders, and other App activity when notifications are enabled;
  • Analyze product usage, website visits, store-link clicks, acquisition sources, feature adoption, and trends so we can improve the Services and measure the effect of releases;
  • Diagnose crashes, errors, synchronization failures, and performance problems;
  • Respond to your comments, questions, and requests and provide customer support;
  • Protect the Services, enforce our legal rights, and comply with legal obligations.

4. Disclosure of Your Information

We disclose information only as needed to operate the Services, comply with the law, or complete a business transaction described below.

4.1 Third-Party Service Providers

The following service providers process information on our behalf:

  • PostHog: product and website analytics, including the Skulpt user identifier used by the App, app and device details, lifecycle events, screen views, product actions, website page paths, campaign parameters, store-link clicks, event outcomes, and approximate country or region;
  • Sentry: error monitoring and diagnostics, including crash reports, stack traces, error context, and app and device information;
  • Cloud infrastructure providers: hosting, processing, and storage needed to run our synchronization API and related backend services.

These providers process information under their applicable service terms and privacy policies.

4.2 No Sale or Advertising Tracking

We do not sell personal information or share it for cross-context behavioral advertising. We do not use information from the Services to track you across apps or websites owned by other companies.

4.3 Business Transfers

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

4.4 Legal Requirements

We may disclose your information if we are required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency), or if we believe disclosure is necessary to: (a) comply with a legal obligation; (b) protect and defend our rights or property; (c) prevent or investigate possible wrongdoing in connection with the App; (d) protect the personal safety of users of the App or the public; or (e) protect against legal liability.

4.5 With Your Consent

We may disclose your personal information for any other purpose with your consent.

5. Data Storage and Retention

The App stores its primary working copy of your data locally on your device in a SQLite database. When synchronization is enabled in an official store build, the App sends data to our API at api.skulpt.app. Synchronized data may include your Skulpt user identifier, profile and settings, notification tokens, workout plans, workouts, exercises, sets, notes, and measurements.

We retain synchronized data for as long as needed to provide the service, meet legal obligations, resolve disputes, and enforce our agreements. Analytics and diagnostic providers retain data according to our configuration and their applicable service terms.

We may retain aggregated, anonymized, or de-identified data that cannot reasonably be used to identify you, indefinitely, for analytical or business purposes.

To request deletion of synchronized personal information, contact us using the details in Section 12. We will process your request as required by applicable law.

6. Data Security

We use reasonable administrative and technical measures designed to protect personal information. No storage or transmission system is completely secure, so we cannot guarantee absolute security.

7. Background Features and Device Permissions

The App may request access to certain features and services on your device. These may include:

  • Apple Health and Health Connect: If you grant permission, the App may read selected profile, measurement, heart-rate, activity, and workout data and may write completed workouts. Access is limited to the permissions you approve in your device settings. We use health data only to provide health and workout features, not for advertising;
  • Push Notifications: We may send you push notifications regarding your workouts, reminders, and other App-related matters. You may opt out of receiving these notifications at any time through your device settings or within the App's notification settings;
  • Background Processing: The App may perform background tasks, such as data synchronization, background audio playback for workout timers, and processing of remote notifications, even when the App is not in active use;
  • Audio: The App may access your device's audio system to play sounds during workouts;
  • Network Access: The App requires network access to synchronize your data with our servers and to provide certain features;
  • Screen and Display: The App may prevent your device's screen from locking during active workouts to ensure uninterrupted use.

You may control many of these permissions through your device's system settings. Disabling certain permissions may limit the functionality of the App.

8. Children's Privacy

The App is not directed to children under the age of 13 (or such higher age as required by applicable law), and we do not knowingly collect personal information from children under that age. If we learn that we have collected personal information from a child under age 13, we will take steps to delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us using the information provided in Section 12.

9. Your Rights and Choices

Depending on your jurisdiction, you may have certain rights with respect to your personal information. These rights may include:

  • The right to access the personal information we hold about you;
  • The right to request correction of inaccurate or incomplete personal information;
  • The right to request deletion of your personal information, subject to certain exceptions;
  • The right to object to or restrict our processing of your personal information;
  • The right to data portability, where applicable;
  • The right to withdraw consent where processing is based on your consent;
  • The right to lodge a complaint with a supervisory authority.

The Services may contain links to third-party websites, services, or applications that are not operated by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of those sites or services. Please review their privacy policies before providing information to them.

Your information may be transferred to, stored, and processed in countries other than the country in which you reside. These countries may have data protection laws that differ from those of your country.
